Best action
Under 40 lbs
I would prefer at least 73 notes.

Nord Piano

People complain about the action, I think it's actually pretty good, and most of the ones that people like better aren't under 40 lbs anyway.

Other possibilities:

Yamaha CP33. I don't like the action as much as Nord Piano, but some people like it. I think most people would agree that the Nord Piano has the better sound though.

Casio PX-5S coming out in a couple of months. You could check out the action by trying one of the already shipping models with the same keybed, like PX-150/350. The PX-5S will be an improvement in piano sound over those models, though.

Roland RD-64 (I know it's smaller)

Let's try a slightly unexpected suggestion: Roland C-200 76 key, 26lbs has 1 piano sound and 1 fortepiano sound, although they don't seem to tell us what action it has.

PX-5S or Nord Piano 2 .... there is nothing else worthwhile

Nord Piano 2 HA88 (40 lbs) or Nord Stage 2 HA76 (36 lbs). I went for Nord Stage 2 HA88 (41 lbs) myself. And you get the cool red color :-)

Nord Piano 2, nothing that I've played that's currently out even comes close. Maybe the Nord Electro 4HP but that's 73. Or the NS2 76 or 88 but all of those still have an inferior action to the NP2. Haven't played the Casio PX5 yet however..

and I think most also agree that the 4HP action is inferior to either the NP2 or NS2.

Controller maybe? I think at 35lbs, the specs of the Roland A-88 would fit your requirements without any compromise:

Has anyone played the Roland C-200 I mentioned earlier? OK, its not really set up as a piano, but looks quite interesting to me, if the piano element is half useable.

Just thought I'd dump the weight data I had collected when I was researching this a few weeks ago (plus the new Casio, from memory). I only looked at 88 keys:

• 24 lbs - Casio PX5S
• 25 lbs - Casio PX150/350 (12" deep)
• 25 lbs - Yamaho P105 (12" deep)
• 36 lbs - Roland FP4F (14" deep)
• 38 lbs - Roland RD300NX (14" deep)
• 40 lbs - Yamaha CP33 (13" deep)
• 41 lbs - Yamaha P155 (14" deep)
• 41 lbs - Korg SP250 (15" deep)
• 52 lbs - Roland FP7F (16" deep)
• 55 lbs - Roland RD700NX (15" deep)
• 61 lbs - Yamaha DGX 640

So out of what I looked at, there's only five keyboards. Eight if you want to push the 40 pound limit just slightly.

I chose the PX350.

Best action and sound is mostly subjective. You have to try them. I did and ended up with the CP33 and could not be happier. The action is excellent, but on the heavy side. The Yamaha piano sound is well sampled and pleasant to play.
