There is no disclaimer that Reblitz has agreed to electronic distribution by Scribd. This is piracy and is a growing problem on the net. It is illegal to post it or even download it and print a copy.

It is also interesting that I received a warning from my virus protection program to not download in any format.

Yes, indeed.

If posting the entire book constitutes "fair use," then copyright is a joke.

Some think that any and all copyright works - print, audio, video - can be uploaded to web so long as it's use is "non-commercial." However, inasmuch as this practice, in effect, beats the copyright holder out of sales, it is the same as stealing. Publishing/reprinting a book is a costly endeavor. The author/pubisher is entitled to monies from sales to recoup the initial investment and, as a business, to make a profit.

It HAVE to provide a lega aspect, but I doubt it is.

That said, the biggest hold up today is due to Google, who want to be the first library in the world.

However - The Reblitz book is available without joining Scribd's subscription service. There is no indication that royalties are being paid.

It will be interesting to see if Mr. Reblitz or Vestal Press will file a complaint.

I didn't realize this until just now. Then, yes, I would assume this particular instance is copyright inringement since published works don't enter the public domain until 50 years after the author dies (I think). Scribd, itself, is unquestionably legal, though. Proper recourse would be to notify Scribd, but I doubt anyone will care that much to do so.

Looks like the scribid user has a total of 174 uploads available for totally free viewing which seems to include numerous copyrighted publications from many different publishers... wonder what that little report button does?

The possible liability questions are interesting. On the face of it, Scribid risks fairly certain liability to the copyright holders if the uploads are unauthorized. But I noticed their user agreement with uploaders contains a "hold harmless" provision, so they could recoup from the uploader. But what if a particular publisher being infringed also has an agreement with Scribid that deals with the issue? Makes me wonder if they use infringement incidents to open the door to publisher agreements like YouTube apparently does.
